Prof Skauradszun spoke about a new EU directive

The 23rd German Insolvency Law Day took place in Berlin from 18 to 20 March 2026. With over 1,200 participants, it is Europe's largest congress for insolvency and restructuring law. It is organised by the Insolvency Law and Restructuring Working Group (AGIS) of the German Bar Association (DAV).

Judge at the Higher Regional Court Professor Hon.-Prof. Dr. Dominik Skauradszun, LL.M. presented a directive adopted a fortnight ago by the European Parliament on the harmonisation of certain aspects of insolvency law (Insolvency III Directive/Harmonisation Directive) and assessed how Part II of the directive on avoidance actions and Part IV on so-called pre-pack procedures can be transposed into German law.

He also took part in a panel discussion with Prof. Dr René Repasi, Member of the European Parliament (MEP), and discussed with Ministerialrat Alexander Bornemann, who heads the Insolvency Law Paper at the Federal Ministry of Justice. Prof Skauradszun urged that the scope of the numerous new provisions should not be underestimated, even though German law is already familiar with many of the legal concepts, as the German provisions will have to be interpreted in the light of the guidelines in future, which will make new arguments and results possible.

Prof Skauradszun's research employee Selina Schweizer, LL.B., LL.M., will obtain her doctorate on the pre-pack procedures regulated in 19 articles - the sale of an enterprise that is at least likely to become insolvent.

Prof Skauradszun will publish an article-by-article commentary on the guidelines with Oxford University Press together with Prof Dr Emmanuel Mastromanolis (University of Athens). He is currently leading a research project with 26 participating European countries. In addition to Selina Schweizer, Stella Hasenauer, who is a student employee of Professor Skauradszun, is also working on this research project. The project will also be supported again from 1 April 2026 by long-standing academic employee Jeremias Kümpel, LL.B., LL.M., M.Sc., who obtained his doctorate in insolvency law under Professor Skauradszun.
