Challenges of the Rule of Law and the DEcline of Democracy: Developing Countries. Case Study: Afghanistan, 2001 - 2021
The rule of law and democracy are fundamental concepts in public law and political philosophy, but they do not necessarily materialize simultaneously. In transitional countries, the weakening of either of these concepts can impact the other, ultimately leading to the decline of democracy and the expansion of authoritarianism. Without democracy, the rule of law turns into "rule by law," legitimizing authoritarianism, while without the rule of law, democracy becomes unstable and prone to corruption. In the 1990s and 2000s, Western countries promoted democracy as part of their foreign policy to expand the liberal international order and achieve "perpetual peace." However, in recent years, the rise of authoritarianism and resistance to the liberal-democratic order have posed significant challenges to this process. In this context, Afghanistan's experience from 2001 to 2021 serves as an example of these challenges. The fall of the Afghan Republic on August 15, 2021, and the withdrawal of U.S. forces not only had significant domestic consequences but also marked the end of the global democracy discourse. This event demonstrated that the simultaneous weakening of the rule of law and democracy could pave the way for the return of authoritarianism. Examining this experience provides a deeper understanding of the challenges faced by transitional countries and the decline of global policies related to the rule of law and democratization.
