Conditions of participation

1

Scope of application

The conditions of participation apply to certificate programmes, continuing education seminars and digital learning paths (hereinafter referred to as courses) offered and run by the Centre for Continuing University Education (ZWW) at Fulda University of Applied Sciences (HFD).

2

Registration form

Your registration is binding. Registrations will be considered in the order in which they are received, provided that the respective attendance and admission requirements listed in the call for proposals are met. Registration is valid for the duration of the continuing education programme specified in the call for proposals. The admission modalities are contained in the respective call for proposals. Sufficient is a registration in text form, e.g. by submitting the online enrolment form, email or fax.

By submitting your registration, you recognise the HFD's conditions of attendance.

3

Confirmation

After submitting the completed online enrolment form or after submitting your individual enrolment form, we will send you a confirmation of receipt. The contract is only concluded when we accept your registration by sending you a binding confirmation of registration immediately after the registration deadline has expired. With the binding confirmation of registration you will also receive all the information you need for your journey and attendance as well as a separate invoice.

4

Attendance fee and terms of payment

A participation fee is charged for each course booked. The participation fee shown in the current programme description is the basics. We reserve the right to change prices for recurring certificate programmes and recurring continuing education seminars. The participation fee must be paid by bank transfer without deduction at the time specified in the invoice. The participation fee includes university studies and seminar documents.

5

Deregistration, refund, transferability

Cancellation by the participant in text form is sufficient, i.e. the statement must clearly identify the participant. The cancellation can be submitted by the participant by post, fax, email or in person.

In the event of deregistration by the expiry of the registration deadline, the participation fee will be refunded in full if it has already been paid. Cancellations up to 14 days before the actual start of the event will be charged 50% of the participation fee.

After this date, withdrawal is no longer possible; the full participation fee is due.

A suitable replacement participant can be provided if they fulfil the participation requirements.

Irrespective of these regulations, a 14-day right of cancellation may pass (see point 6 of these conditions of participation).

6

Cancellation policy for consumers

a) Right of cancellation

If you as a participant are a consumer within the meaning of § 13 BGB, you have a statutory right of cancellation. You have the law to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days and begins on the day the contract is concluded, i.e. the day you receive our registration confirmation.

To exercise your right of cancellation, you must contact us at

by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to cancel this contract.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

b) Consequences of cancellation

If you cancel this contract, we will refund the amount we have received from you immediately and at the latest within fourteen days from the date of receipt of your cancellation.

c) Premature expiry of the right of cancellation

When registering for the digital learning paths "Social Law for Case Management" and "Civil Law Basics in Social Work", you expressly agree that the execution of the contract will begin before the expiry of the cancellation period. You confirm that you will lose your statutory right of cancellation upon commencement of the performance of the contract (time of sending the personal access data and the login link). You will receive a copy of this in the form of an automatically generated confirmation of receipt of your online registration.

7

Cancellation, changes and postponements of events / change of lecturer

If a course is cancelled from the outset due to insufficient participation, interested parties will be notified after the registration deadline and will not receive a confirmation of registration.

In addition, the HFD may cancel a course due to insufficient participation. Cancellation due to insufficient participation must be announced no later than three weeks after receipt of the registration confirmation. In the event of cancellation, fees already paid will be refunded. No claim to the realisation of the course passes.

In addition, the HFD reserves the right to cancel or postpone a course at short notice for important reasons, for example due to illness of the instructors. In particular, postponements of the programme after the start of the event due to events unforeseeable by the HFD and/or the transfer of instructors shall not entitle the participant to withdraw from the contract or reduce the participation fee. If individual dates within the course are cancelled, the ZWW will organise alternative dates. Further claims are excluded.

8

Copyright protection and retention of title

a) The study materials are subject to copyright protection and may not be duplicated without the authorisation of HFD. Each participant has the law to use the contents of the courses for his/her personal purposes, to print them out for him/herself or to save them as files. Participants may not pass on photocopiers to third parties. The recording of online courses by participants is not admitted.

b) We reserve unrestricted ownership of all deliveries of seminar documents until all payment obligations of the participant(s) have been fulfilled in full. Resale of the seminar documents is not admitted.

9

Liability

HFD shall only be liable for damages resulting from an intentional or grossly negligent breach of duty by HFD, its legal representatives or vicarious agents. This does not affect liability for injury to life, limb and health or for breach of material contractual obligations. Participants must notify ZWW immediately in writing of any personal injury or damage to property, stating the circumstances. Any misuse of the hardware and software provided by ZWW may manage claims for damages on the part of HFD or third parties.

10

Data protection

Participants agree to the storage of their data. HFD undertakes to use this data exclusively for event administration purposes. Please also note the data protection information. Attendance at online courses is only possible if the participant agrees to the use of third-party tools. HFD has no influence on the content of the data protection statements of third-party providers.
